FAQ: Washington State Initiative 502

"Initiative 502 legalizes the sale, possession, and use of marijuana in Washington State."

Q: When can I buy some weed?

A: June 2014 is the states estimate on having the system up and running. As the state continues to move ahead with the licensing process, retailers could be open this summer. At which time, adults (21+ years old) will be able to legally purchase cannabis, and cannabis related products, from licensed retailers. Buying from your regular guy (wink)... is still illegal.

Q: Do I have to be a Washington state resident?

A: No. But you will need an I.D. for proof of age.

Q: How much can I purchase and possess?

A: State law allows for the possession, and or purchase of any combination of: 1 ounce (28grams) of marijuana (buds), 16 ounces of marijuana in solid form (edibles) or 72 ounces in liquid form (infused products).

Q: How much does it cost?

A: Beyond the tax rate, the state will not regulate the price. The final price will be determined by the market.

Q: I'm from out of state, can I take some home?

A: No. All purchases must be consumed with in the state.

Q: Can I fire up a joint at the park?

A: No. All marijuana related products, must be consumed away from public view. This also applies to cannabis retailers, coffee shops, bars and similar establishments.

Q: Is it legal to grow marijuana at home?

A: No, I-502 requires that all cannabis, and related products be, purchased at a state licensed retailer. Legal medical grows, are not subject to restrictions under I-502.

Q: What about DUI?

A: I-502 sets a THC (delta 9) DUI limit of 5 nanograms per milliliter of blood (5 ng/mL). State and local law enforcement agencies, will be enforcing the limit.

Q: Can I get fired for failing a drug test?

A: Yes. Marijuana remains a Schedule I controlled substance under federal law. Which means, that employers, can still fire you for a failed test. This, also applies to medicinal use. Initiative I-502, does not specifically address work place drug testing.

Q: What is the federal government going to do?

A: Wait and see... In August, 2013 the US Department of Justice, sent a memo to both Governors, Jay Inslee (Washington) and John Hickenlooper (Colorado) outlining the government’s position on legalized cannabis. The memo focused on 8 key points, such as public safety and access to minors. While both states have moved to comply with the memo... it does not change federal law. It'd be wise, to "not", take your weed into a federal court house or onto federal property.
